Senior counsel Amit Desai who was arguing for the bail of Arbaaz Merchant, Told the Bombay HC that based on the assessment of articles recovered on Oct 3, only 'consumption' was alleged.

"If there was no conspiracy at that moment, how come conspiracy came later," he asked.



"The arrest was illegal," he said while going on to add, "I point out a Supreme Court judgement which says arrest is an extremely strong measure and should be exercised only to prevent the accused from committing another crime or preventing him from running away from the law."

who has been hearing the bail application since Tuesday, also heard Munmun Dhamecha's lawyer's argument.

After the hearing which went on for over two hours, Justice Sambre said he would hear Additional Solicitor General Anil Singh, who is representing the

Narcotics Control Bureau

(NCB), on Thursday.

"Tomorrow we will try to finish it," the judge said.

After the court was adjourned, Munmun's lawyer said in a statement to the media, "Arguments of all three accused have been concluded today. It has been kept for further argument tomorrow at 3 pm."

Aryan, Arbaaz and Munmun approached the HC last week after a special court for NDPS Act cases rejected their bail pleas and extended their custody till October 30.
