AURANGABAD: The
Aurangabad bench of the Bombay high court
recently served a contempt notice to a private school after its management sent a show-cause notice on May 26, 2016 to the headmaster Kondba Sandve seeking an explanation for approaching the court.
A division bench comprising justices RM Borde and PR Bora said, “Framing of such a charge and calling for an explanation from an employee for approaching the high court for availing the constitutional remedies amounts to interference in the course of administration of justice and a citizen cannot be prohibited from availing the constitutional remedy for redressal of his grievances before the court.”
The court ordered the management’s president,
Marotrao Nagorao Shinde
, to show cause as to why action should not be taken against him for contempt of court.

had filed a petition in 2014 pleading that Sandve, being the seniormost teacher, be granted approval for joining as headmaster in Adarsh Secondary and
Higher Secondary School
at
Manthan of Hadgaon
tehsil in Nanded district.
The then division bench presided by justice S V Gangapurwala and justice A M Badar on September 29, 2014, issued directives for the appointment.
Within months, the school had a new management with Shinde as the president who set aside Sandve’s appointment in favour of the former’s son, Suhas.
Sandve again approached high court in 2015 pleading for his reinstatement. His lawyer,
Madhukar Giri
, said the court had then ordered a status quo. While the matter was before the

, Shinde issued a show cause to Sandve which invited the court’s reaction
